Defra and the Welsh Government are seeking views on the accuracy of the draft Environmental Permitting (England and Wales) Regulations 2016.
They are asking if the draft Environmental Permitting (England and Wales) Regulations 2016 are accurate and want to be sure that “no errors have occurred as part of the drafting process.”
These regulations will reflect the up-to-date legal position, bringing together all the amendments to the 2010 regulations. They are expected to come into force on 1 January 2017.
“As there is no change in policy, we are not asking for views on policy issues, or on the overall structure of the draft regulations,” the consultation states.
A letter sent to stakeholder says there are likely to be further amendments to the EPR 2010 that will be drawn into the consolidation before the consolidated Regulations are laid.
These include proposals to incorporate flood defence consenting into the environmental permitting regime; and strengthening the enforcement powers of the Environment Agency and Natural Resources Wales to tackle waste crime and poor performance in the waste industry.
